    NOTICE AND TERMS OF AGREEMENT
    Buyer agrees to the following terms by remittance of the agreed upon purchase price.
    ("Seller") agrees to sell to ("Buyer") the automobile listed in the above captioned listing to be further described in detail in the purchase agreement and hereinafter as (the “Vehicle”), pursuant to these terms:
    1.
    The date of the sale of the Vehicle will be upon the receipt of funds and shall run until the date of Delivery.
    2.
    Delivery and is complete upon the date of inspection and acceptance by the Buyer.
    3.
    The Buyer agrees to pick up the vehicle or arrange and pay for shipping of the vehicle, by third party or shipping company of the Buyers own choosing.
    4.
    In exchange for the Vehicle, the Buyer will pay Seller the total purchase price of the Vehicle on the day of the sale by cashier’s check, money order, or cash. The Buyer is responsible for any state taxes.
    5.
    After receipt of payment as provided above, and upon the day of pick up or shipment The Seller agrees to provide the following documents to Buyer on the sale date:

    Certificate of Title (including Odometer Disclosure Section), signed by Seller.

    The current registration for the Vehicle.
    6.
    The Seller agrees to make the Vehicle available for pick up or shipment to Buyer with a current registration and a clear title.
    Seller warrants that Seller is the legal owner of the Vehicle and that the Vehicle is free of all legal claims, liens, and encumbrances.
    7.
    The Buyer will have the opportunity for inspection either in person or by a third party, on the date of pick up or shipment, which shall be within 7 days of the date of remittance.
    8.
    The Buyer upon taking possession of the vehicle, either in person, by third party purchaser or shipping company agrees and accepts the vehicle (UCC 2-606). Buyer further agrees that the Seller has satisfied his requirements under the UCC to “perfect tender” and “delivery of tender.”
    9.
    Buyer further acknowledges and accepts the vehicle is sold “AS IS” and agrees that the vehicle “IS AS ADVERTISED”. Buyer further agrees and acknowledges that the Seller does not offer refunds and all sales are final.
    10.
    Buyer agrees that the laws of the State of Washington shall control the terms of the agreement.
    11.
    Buyer agrees that any disputes or claims shall be resolved as follows: First, mediation by a qualified mediator of the Sellers choosing. If an agreement cannot be reached, then by binding arbitration. The Seller shall be entitled to recoup any fees associated with mediation, arbitration, or litigation.
    12.
    Prior to any dispute resolution as mentioned in paragraph 11. The Buyer shall provide the Seller with written notice of the terms of the dispute and give the Seller, not less than 15 days, to resolve any dispute. Notice must be given not less than 30 days prior to taking any legal action.
    13.
    The Vehicle is sold "as is," and the Seller makes no express or implied warranties as to the condition or performance of the Vehicle, except as follows: to the best of Seller's knowledge, this vehicle:
    is not a salvage vehicle unless stated in the listing.
    has not been declared a total loss by an insurance company.
    has not been repaired pursuant to a Lemon Law.
